Event Terms
The following event terms and conditions (the “Event Terms”) govern your registration and attendance at any Databricks event (the “Event”) and are an agreement between you and Databricks, Inc. and its affiliates and subsidiaries (hereinafter “Databricks”). You represent to us that you are authorized to enter into these Event Terms, which may be updated from time to time. Registering to attend or participating in an Event constitutes your acceptance of these Event Terms.
Promotion Codes
If you have purchased or received a promotion code, such codes may not be shared or provided to anyone outside your company. Only one (1) code can be applied per registration. Databricks reserves the right, including without prior notice, to cancel or impose conditions on the honoring of any promotion.
Payment
Event fees may apply to your attendance or participation in an in-person or virtual Event. Payment (if applicable) must be provided in the manner and at the times noted on the Event registration page or FAQs. Registration is not confirmed until payment has been received and Databricks reserves the right to cancel your registration without notice for failure to pay as required. Unless specified otherwise, prices are noncancelable and nonrefundable, and valid exclusively for the specified Event (e.g., a Data + AI Summit 2023 ticket may not be used at Data + AI Summit 2024). You are responsible for any taxes applicable to your payment transactions.
Refunds, Substitutions and Cancellations
Databricks may permit a refund or substitution of your registration for certain Events to another person within your company at Databrick’s discretion, subject to the Event’s applicable refund, substitution and cancellation policies set forth on the Event registration page or FAQ. There are no refunds or credits for no‑shows. Payments made for one Event may not be applied toward the purchase of any other Event. Cancellation of travel reservations and hotel reservations is your exclusive responsibility. Databricks is not responsible for any damages, direct or indirect, resulting from any canceled registration or impermissible substitution.
Minimum Age
For evening Event activities, you must be at least 21 years of age to attend.
Badges
You may be required to present identification and pick up a badge at the Event check‑in area before entering the Event. If badges are required for admittance, they must be worn and visible at all times while you are at the Event and during any activity associated with the Event. Badges may not be shared or exchanged with any person.
Personal Information
Databricks will handle your personal information collected during registration in accordance with Databricks's Privacy Notice.
Registration Information. You agree that Databricks may use your registration information to send you updates and requests for feedback regarding the Event. You also agree that Databricks may use and disclose your personal information to its third‑party service providers to process your registration. Such third parties may have their own privacy policies that apply to their processing of your personal information.
Disclosing Your Registration Information. Badges may contain technology that may be used to record your attendance and participation in the Event (including visiting booths and attending sessions). You authorize Databricks to disclose your registration information to Event Sponsors to use in accordance with their privacy policy if (a) you scan your badge, elect to visit a sponsor’s booth, or attend any in-person or virtual sessions or other activities at an Event involving Event Sponsors (in which case we would provide your registration information only to the Event Sponsor involved in such session or other activity,) or (b) you opt-in during registration or otherwise to receive communications from our Event Sponsors. Databricks is not responsible for the privacy practices of any Event Sponsor or other third party. Please contact the Event Sponsor or third party to learn more about its practices with respect to any information that it collects or to unsubscribe from its marketing communications.
Recordings
You may not record any sessions at an Event without prior approval from Databricks. You acknowledge and agree that the Event is a public event, that your appearance and actions inside and outside the venue where the Event occurs are public in nature. Databricks, including its affiliates, partners, vendors and other third parties, may choose to photograph and record certain portions of the conference, including in public areas, which may capture images, video and/or recordings of conference participants. By virtue of your attendance at the Event, you acknowledge and consent that your likeness and/or voice may be captured in these materials and grant Databricks and such third parties the right to use, modify, reproduce, broadcast, distribute, display, or incorporate in any manner whatsoever, all or any portion of these materials, free of charge, for marketing, training and internal purposes. You hereby waive “moral rights” in such photos, recordings, or other digital content.
Government Attendees
If you are a government employee or official, you must identify yourself as such during the registration process for an Event, and, for an in-person Event, you may be asked to present your government-issued employee badge during the check-in process. If you are offered free or discounted attendance or participation at an Event, you must disclose your attendance at the Event to your employing government agency in advance, and obtain such agency’s permission for you to accept free or discounted attendance at such Event. You must also confirm your compliance with the foregoing upon request by Databricks and comply, for the entire duration of the Event, with all applicable rules, regulations and policies imposed by your employing agency, including those relating to the acceptance and disclosure of gifts and gratuities.
Event Conduct
You are required to comply with the Databricks Code of Conduct and the rules of the venue. Databricks reserves the right to refuse admission to, or to eject, any person who has registered under false pretenses (e.g., companies or attendee names that do not exist, individuals who are under-aged, etc.) or who fails to follow any of Databricks’ other rules or directions, as determined by Databricks in its sole discretion.
Changes to event
Databricks reserves the right to make any changes to the Event, its content and/or programs offered at any time and without notice, including the availability or suitability of venue or speakers or on security, health, or safety grounds, and in the event of any natural or public disaster, insufficient participation or sponsorship, government regulation or shutdown, necessary venue construction, labor controversy, civil disturbance, acts or threats of terrorism, armed conflict or similar reasons beyond its reasonable control. Databricks is not responsible for, and no reimbursement will be issued in the event of, any change to an Event.
Safety and Security
Your safety and security are important to us. You understand that you and your property may be subject to a reasonable search upon entry to the Event and you may be asked to provide photo identification. Your bags may be required to be stored during the event. If you refuse to participate in these security measures, we may deny you entry. We also reserve the right to ask you to leave the Event if your behavior causes us concern for the safety or security of Event attendees.
Assumption of Risk; Health and Safety
YOU UNDERSTAND THAT PARTICIPATION IN THE EVENT IS VOLUNTARY AND YOU ACKNOWLEDGE AND AGREE THAT: (I) ATTENDING IN-PERSON EVENTS CARRIES WITH IT CERTAIN INHERENT RISKS THAT CANNOT BE ELIMINATED REGARDLESS OF THE CARE TAKEN TO AVOID INJURIES; AND (II) IN-PERSON EVENT PARTICIPATION INCLUDES POSSIBLE EXPOSURE TO AND ILLNESS FROM INFECTIOUS DISEASES. YOU UNDERSTAND AND ASSUME ALL RELATED HEALTH AND SAFETY RISKS ASSOCIATED WITH ATTENDING THE EVENT, INCLUDING RISKS RELATED TO COVID-19. Attendees will be required to meet any government-mandated health and safety requirements (including vaccination requirements), or any health and safety requirements imposed by the host or venue, to attend. If we deny you entry or require you to leave, you will not receive a refund.
Release of Claims
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU HEREBY EXPRESSLY AGREE TO RELEASE DATABRICKS, ITS OFFICERS, DIRECTORS, EMPLOYEES, VENDORS, PARTNERS, AGENTS AND CONTRACTORS, SUCCESSORS, AND ASSIGNS (COLLECTIVELY, “RELEASEES”) FROM ANY AND ALL ALLEGED AND/OR ACTUAL LIABILITY, CLAIMS, ACTIONS, LAWSUITS, DAMAGES AND LOSSES OF ANY KIND WHICH ARISE OUT OF OR RESULT FROM YOUR ATTENDANCE AT AND PARTICIPATION IN THE EVENT AND ANCILLARY ACTIVITIES, INCLUDING BUT NOT LIMITED TO PROPERTY DAMAGE, FINANCIAL LOSS, PERSONAL OR PSYCHOLOGICAL INJURIES, ILLNESS, PAIN, TEMPORARY OR PERMANENT SUFFERING, DISABILITY, DEATH OR OTHER PHYSICAL LOSS, WHETHER OR NOT FORESEEABLE, AND WHETHER ARISING OUT OF THE ORDINARY NEGLIGENCE OF DATABRICKS OR ANY RELEASEES OR OTHERWISE. YOU COVENANT NOT TO MAKE OR BRING ANY SUCH CLAIMS AGAINST DATABRICKS OR ANY OTHER RELEASEE, AND FOREVER RELEASE AND DISCHARGE DATABRICKS AND ALL OTHER RELEASEES FROM LIABILITY UNDER SUCH CLAIMS. THIS WAIVER AND RELEASE DOES NOT EXTEND TO CLAIMS FOR GROSS NEGLIGENCE, WILLFUL MISCONDUCT, OR ANY OTHER LIABILITIES THAT CALIFORNIA LAW OR OTHER APPLICABLE LAW DOES NOT PERMIT TO BE RELEASED BY AGREEMENT.
Limitation of Liability
DATABRICKS AND OUR AFFILIATES AND LICENSORS WILL NOT BE LIABLE TO YOU UNDER ANY CAUSE OF ACTION OR THEORY OF LIABILITY, EVEN IF A PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, FOR (A) INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR (B) LOST PROFITS, REVENUES, CUSTOMERS, OPPORTUNITIES, OR GOODWILL. IN ANY CASE, DATABRICKS AND OUR AFFILIATES’ AND LICENSORS’ AGGREGATE LIABILITY UNDER THESE EVENT TERMS WILL NOT EXCEED THE EVENT REGISTRATION FEES, IF ANY, PAID BY YOU TO AND RECEIVED BY DATABRICKS FOR THE EVENT GIVING RISE TO THE LIABILITY. THE LIMITATIONS IN THIS SECTION APPLY ONLY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.
Governing Law
These Event Terms and all claims arising hereunder will be governed by and construed in accordance with the exclusive venue, unless required by applicable data protection law, as provided below, without regard to conflict of law provisions.
